General Rules (“Rules”) For The McDonald’s Advantage Club Free Prize Draws

1. Participants

You must be a UK, Isle of Man or Channel Islands resident and be 18 years of age or older. The following are not eligible to participate: (i) Employees and immediate family members of employees of any of McDonald’s Restaurants Limited (“McDonald’s ”), its franchisees, licensees, subsidiaries, agents and advisors, (ii) other persons assisting with this promotion, (iii) any syndicate or collection of persons acting in concert, (iv) any person using the services of an entity carrying on the business of entering (or advising on entering) prize promotions and (v) any such entity.

2. The Promotion

Individual McDonald’s Advantage Club Free Prize Draws (each a “Draw”) will be promoted from time to time on McDonald’s website at www.mcdonalds .co.uk (the “Site”) during this promotion. Specific rules for each Draw (the “Draw Rules ”) will be posted elsewhere on the Site at the relevant time and will describe the name and date of the Draw, any requirements as to eligibility, the last date for qualifying to be entered into the Draw, the prize(s ) to be won and any additional conditions attached to the prize and/or any other terms which are specific to that Draw and are to prevail over these Rules.

If no qualifying date for entry into a Draw is stated in the relevant Draw Rules then entries for that Draw will be comprised of

(a) those persons who have been registered as members of the McDonald’s Advantage Club (“the Club”) in the calendar month immediately preceding the calendar month in which the relevant Draw is to be made and who remain members at the date of the Draw and
(b) those persons for whom a valid postcard entry in accordance with Rule 3 below has been received in the calendar month immediately preceding the calendar month in which the relevant Draw is to be made.
Future Draws will continue to be promoted until such time as McDonald’s elects (in its discretion) to suspend or terminate the conducting of any further Draws, whereupon notice of this will be placed on the Site for a limited time.

For the avoidance of doubt, these Rules shall continue to apply wherever the context admits in relation to any Draw conducted by the Club under its former name of “The Family Club” as if all references to “McDonald’s Advantage Club” were to the Family Club.

3. How To Enter

By registering via the Site as a member of the Club, subject to the Draw Rules for each Draw, you will be entered into each Draw beginning with the first Draw to take place following the calendar month in which McDonald’s has completed the registration process to its satisfaction for your application. Entry will be automatic for such time as you remain a Club member and have not notified us of your wish not to take part in this promotion.

You may notify us of your wish not to take part in the Draws by sending a postcard or letter to this effect with your name and address, signed by you, addressed to: Advantage Club Free Prize Draws – Non-participation Request, McDonald’s Webmaster, Level 2, 26 - 28 Hammersmith Grove, London W6 7AW.

You can enter a single Draw without registering as a Club member by clearly and legibly printing your name, address, postcode and age in block capitals on a postcard and signing the same to certify your age before sending it properly stamped (franking is not acceptable) to: McDonald’s Advantage Club Free Prize Draws – Postal Entry, McDonald’s Webmaster, Level 2, 26 - 28 Hammersmith Grove, London W6 7AW.

Limit of 1 prize per household or family, whether by means of automatic entry through Club membership or by postcard entry.

4. Conduct Of Each Draw

All valid entries for a Draw will be collated and will compete for the prize or prizes described in the Draw Rules for that Draw. The prospective Draw winner or winners will be the first valid entry or entries drawn at random on the date the Draw is conducted. Where there is more than one prize available, the number of winners will be determined by the number of prizes available for that Draw (as stated in the Draw Rules), each winner being awarded the prize in the list set out in the Draw Rules which corresponds with the order in which that person’s valid claim is drawn as compared to previously-drawn, valid claims. The prize claim or claims must be made in accordance with the Draw Rules and Rule 5 below.

McDonald’s may cancel a Draw if in the sole discretion of McDonald’s insufficient entries have been received and processed by the Draw date end of the immediately preceding month, whereupon any postcard entries received for the cancelled Draw will automatically be entered into the next following Draw (if any).

5. The Prize

The prize descriptions are illustrative and not definitive. Further details available on written request sent by pre-paid post to Advantage Club Free Prize Draws, c/o Corporate Marketing, McDonald’s Restaurants Ltd. 11-59 High Rd East Finchley London N2 8AW. Prizes may not be exchanged, encashed or transferred. All cash prize amounts are stated in sterling, unless otherwise stated in the Draw Rules. Winner’s notification will be dispatched by post to the address (for Club members) provided on registration with the Club or as updated from time to time or (for non-members) on the postcard entry within 30 days of the relevant Draw. Each prize is awarded conditionally upon the acceptance by the winner and (if relevant) his or her companions sharing the prize of the terms and conditions of the prize provider or, in the case of more than one contractor being involved in the provision of a prize, the providers. Details of such terms and conditions for a particular Draw may be obtained during the calendar month of the Draw and (wherever practicable) in both the calendar month immediately preceding and that following the month for the Draw, by sending a stamped self-addressed envelope to Advantage Club Free Prize Draws – Request for Contractor’s Terms and Conditions at the address stated above.

All unawarded or unclaimed prizes will lapse if not the subject of valid claims within the time limits as prescribed by the Draw Rules.

Holiday Prizes:
If the prize is a holiday prize, it (i) will be subject to accommodation, flight and resort availability, (ii) must be taken between the dates stated in the notification letter, and (iii) may not be taken at certain peak times, details of which will be provided as and when available in respect of a specific holiday prize on receipt of written request sent by pre-paid post to the promotion centre address as follows: McDonald’s Restaurants Ltd. 11-59 High Rd East Finchley London N2 8AW.

On notification, each holiday winner will receive a Holiday Acceptance Form and Liability Release Form (prepared by McDonald’s releasing, wherever permitted by law, McDonald’s, its related companies, franchisees and agencies concerned with conducting this promotion and their respective employees, officers and agents from responsibility or liability for claims in respect of such holiday) for the winner and each person taking the holiday (if applicable) all of which must be properly completed and returned in accordance with the instructions in the notification letter to arrive by no later than 14 days after the date McDonald’s posts the notification. Failure to comply in any respect with this requirement will result in the holiday being withheld and the winner’s entry for that Draw becoming void, whereupon McDonald’s may (but shall not be required to) reallocate the holiday to the next valid entry drawn from that Draw.

Each holiday winner should check with any relevant authorities regarding passport and visa requirements; it is the sole responsibility of winners and their companions to produce all requisite travel documentation. Travel and other insurance is not included and it is strongly advised to take out insurance cover for all appropriate risks. Any costs incurred additional to the prize package elements advertised (or listed in the Draw Rules) are at the expense of winners and/or their companions.

6. Responsibility

To the fullest extent permitted by applicable law (but not otherwise) McDonald’s and its agents assume no responsibility and are not liable for (i) the accuracy or otherwise of the prize description or illustration, (ii) any representation, warranty, condition or guarantee in respect of a prize (other than those warranties or conditions implied by statute and which cannot be excluded), (iii) the non-availability, loss, late receipt, damage, illegibility or non-readability of a prize, any application to join the Club, notification, or other communication (iv) verifying whether the person awarded a prize is the person entitled to claim that prize, (v) any taxes, fees, charges or other costs which winners may be required to pay any time in connection with a prize, (save to the extent that McDonald’s has expressly and specifically accepted responsibility in these Rules and/or the Draw Rules for the same).

7. McDonald’s Rights

McDonald’s may (i) extend any time limit or waive any of the Rules where a person might otherwise have been disqualified (without obliging McDonald’s to relax the Rules in any other case whatsoever), (ii) terminate, suspend and/or extend any Draw or this promotion at any time due to supervening circumstances beyond McDonald’s control including (but not limited to) technical or operational problems with the Site or for any fact, matter or circumstance which (in McDonald’s opinion) adversely affects, or may adversely affect, the proper, fair or secure conduct or operation of any aspect of this promotion or its administration (in which event notice of such termination, suspension or extension shall be placed on the Site for a limited time) and (iii) substitute a product deemed to be an appropriate replacement and of equal or greater value in the place of any of the prizes. McDonald’s decision in the exercise or interpretation of any of its rights or discretions in connection with these Rules and the Draw Rules shall be final and binding.

8. Assuarance

McDonald’s will observe the British Codes of Advertising and Sales Promotion Practice when extending any deadline or otherwise exercising or relying upon any of its rights and remedies in these Rules.

9. General

A list of the names and counties of each prize winner may be obtained after the relevant Draw by sending a signed hand-written request along with a stamped self-addressed envelope to: McDonald’s Advantage Club Free Prize Draw (Details of Winner Request), c/o Corporate Marketing, McDonald’s Restaurants Ltd. 11-59 High Rd East Finchley, London N2 8AW. McDonald’s may also wish to publicise on the Site statements made by or attributed to prize winners relating to McDonald’s or this or any other promotion or offer, unless otherwise requested.

McDonald’s may require such information (in addition to the information required to be given on applying to join the Club or, if not applying, on a postcard entry) as it considers necessary or desirable for the purposes of verifying eligibility or the validity of any entry and any prize may be withheld unless and until McDonald’s is satisfied with the verification. All instructions, rules and conditions on the Site (other than the Draw Rules), together with any advertising or promotional materials relating to this promotion and on notification letters and Liability Release Forms, form part of the Rules although, in the event of conflict, the provisions set out above and below shall prevail over all such other instructions, rules and conditions

By applying to join the Club or sending a postcard entry, you agree (i) that McDonald’s may use all information given in the application or on the postcard entry for McDonald’s’ general reference and in-house news communications without requirement as to any additional notice, any consent or any entitlement as to payment or other compensation and (ii) to be bound by the Rules and to their interpretation under English law and by the English courts.

Any entry will be void if it is deemed (in McDonald’s discretion) to have been made by an ineligible person or (in the case of a postcard entry) to be incomplete, illegible, or damaged.

Nothing in these Rules shall affect your statutory rights. McDonald’s may (in its sole discretion) decline to enter into any correspondence save as otherwise stated in these Rules.
