McDonald's Football Promotions Terms and Conditions

SUPPLEMENTAL RULES FOR THIRD PARTY PROMOTIONS FEATURING FOOTBALL-THEMED PRIZES SUPPLIED BY McDONALD'S APPLICATION OF SUPPLEMENTAL RULES

These supplemental promotional rules ("General Rules") apply to any prize promotion which is promoted by a media partner or other person ("Promoter") in association with McDonald's Restaurants Limited ("McDonald's") whereby McDonald's sponsors the promotion by providing a prize or prizes and where the conditions of entry for that promotion incorporate by reference these General Rules (each a "Promotion"). Nothing in these General Rules shall imply that McDonald's is a promoter or co-promoter of any Promotion by reason of such association.

By participating in a Promotion, each entrant agrees to be bound by the "Rules" which expression shall include the General Rules and any terms and conditions and other regulations publicised by the Promoter as applying to that Promotion (defined for the purposes of these General Rules alone as the "Promoter's Rules" and which shall prevail in the event of conflict with these General Rules).

To the extent McDonald's deems it appropriate, McDonald's shall be entitled to treat any of its rights under the Rules as having been granted for the benefit of McDonald's and one or more of agencies and commercial partners (including without limit the Football Association Limited, the Scottish Football Association Limited, FAW Football in the Community Limited/The Football Association of Wales Limited and the Irish Football Association Limited).

SUPPLEMENTAL RULES FOR PROMOTIONS

Participation
To participate in any Promotion each entrant must be:

at the time of entry or such other time as may be stated in the Promoter's Rules between any minimum and maximum ages as stated in the Promoter's Rules or (in the absence of such statement) 18 or over (provided that if entry is permitted by the Promoter for anyone under 18 then it shall be a pre-condition of entry that the entrant's parent/guardian certifies that (1) he/she is the parent/guardian of the entrant named on the application form (2) he/she authorises the entrant to enter the Promotion and if successful to attend any events, if applicable (3) he/she, or another responsible adult who has been approved in advance by McDonald's, undertakes to accompany the entrant to attend any event, if applicable and (4) he/she and the entrant will comply with the Rules), UK resident or (in the case of Player Escort Programme prize-places) resident in the Home Nation of the relevant match-venue, and compliant with any other eligibility requirements in the Promoter's Rules.
The following are not eligible to participate: (i) Employees and immediate family members of employees of any of McDonald's, any company responsible for redemption of prizes/vouchers or for supplying prizes for the Promotion and their respective franchisees, subsidiaries, agents and advisors, (ii) other persons assisting with this Promotion, (iii) any person not being an individual person, (iv) any syndicate or collection of persons acting in concert, (v) any person entering via an agent or using the services of or which is an entity carrying on the business of entering (or advising on entering) prize promotions.

Duration
Each Promotion is scheduled to take place on the dates and with the frequency stated in the Promoter's Rules for the relevant Promotion. All dates are inclusive unless otherwise stated.

How To Enter
All entries must comply with the entry criteria set out in the Rules ("Entry Criteria"), which may include:

Questions:
one or more questions are required to be answered correctly by entrants as a pre-condition (unless otherwise stated in the Promoter's Rules) to being entered in to a further stage of the Promotion such as a Draw or a judged tie-breaker as set out in the Promoter's Rules. The correct answer(s) to a question(s) or the best response to a tie-breaker, shall be determined by the judge(s) stated in the Promoter's Rules (and where none is stated such judge shall be McDonald's or a judge selected in McDonald's sole discretion). The judge(s) may elect to identify the correct answer(s) to a question(s) solely within the subsisting information at the Promoter's website and/or the websites of any relevant football association and at www.mcdonalds.co.uk ("the Site").

Submissions:
the requirement for each entrant to complete and submit a creative exercise as described in the Promoter's Rules which submission may comprise the following:

a photograph taken by the entrant (and in the absence of any Promoter's Rules stating otherwise, it shall be no larger than 5" x 7" if a paper print or 500 KB if a digital file and shall be submitted as a digital jpeg file without any digital manipulation e.g. using photoshop), and/or a typed or written work (which, if to be written and in the absence of any Promoter's Rules stating otherwise, shall be hand written in the entrant's own words). The wording must be kept within any designated area or word limits described in the Promoter's Rules, failing which any misplaced or excess wording will be disregarded.
By entering a submission each entrant (irrespective of whether or not the entry is, or is later, adjudged void) (i) understands and accepts that the submission may be used by McDonald's in connection with the posting of any feature on the Site and (ii) hereby assigns ownership of that submission and of all copyrights and other similar rights Worldwide in or over the same to McDonald's absolutely for use (whether or not after adapting, adding to or editing the entry) as McDonald's sees fit and, apart from any prize which may be awarded under these Rules, without any rights to be compensated, to be identified with the entry or to object to any use made of it. Each entrant also warrants that the entry is the entrant's original work and that the entrant has obtained all necessary consents from persons whose consent is required for the use of the entry by McDonald's as envisaged by these Rules and without right for such other persons to charge McDonald's for such use.

Permitted methods of entry which may be stated in the Promoter's Rules may include any or all of the following methods, in which event the following provisions shall apply (to the extent not inconsistent with the Promoter's Rules, namely:

Entry via an Online Entry Form on the Promoter's website: Entrants must (i) comply with the Entry Criteria, and (ii) complete the online entry form and submit it in accordance with the instructions provided on the form.

Entry Using a Form Printed From the Promoter's website or created by the Entrant: Entrants must (i) print the form from the Promoter's website or follow any Promoter's Rules giving direction as to the size and composition of the form (as appropriate) and should not write or print outside of any spaces or dimensions indicated as available for the purpose, (ii) comply with the Entry Criteria, (iii) ensure the form is signed by the entrant and (if appropriate) the entrant's parent/guardian, and (iv) post the form enclosing the entry form in a properly stamped (-franking is not acceptable-) handwritten envelope addressed as directed in the Promoter's Rules.

Entry by Email: Entrants must (i) comply with the Entry Criteria, (ii) send the email containing the required information and the entrant's name and contact details to the email address provided in the Promoter's Rules.

Entry by Telephone: Entrants must (i) comply with the Entry Criteria, (ii) telephone the phone number stated in the Promoter's Rules and follow the instructions and provide all information requested. (Unless otherwise stated in the Promoter's Rules) all entry/claims/redemption phone-lines numbers are charged at no more than your normal operator tariff (except for '087' and '084' numbers which have a rate per minute not exceeding 5p when called from a normal BT landline - this rate may vary for other network operators). Phone-lines are open only during working hours, unless otherwise stated.

For Entry by Sending an SMS: Entrants must (i) comply with the Entry Criteria, (ii) have access to a UK mobile phone, (iii) send your name and contact details in a SMS message (together with any answer to any questions, where applicable) to the number indicated. SMS messages will be charged at your normal operator tariff (unless otherwise stated in the Promoter's Rules).

If using a computer, telephone/mobile phone and/or internet-access which is not owned by the entrant, the entrant is reminded please to get the owner's permission before entering.
In each case entries must be received by the Promoter by no later than the closing date for receipt of entries as stated in the Promoter's Rules, failing which any entries not so received will be void.
Unless otherwise stated in the Promoter's Rules, there is a limit of one entry per person per Promotion.
No entries can be returned, but entrants agree that the Promoter may edit the entries or any features of those entries (including submissions) and McDonald's may publish the same on its Site (without rights of anyone to be compensated).
Conduct of Promotions

All valid entries received which have fully complied with any conditions set out in the Promoter's Rules including (for Promotions which have more than one stage) answering a question or questions correctly or other activity for an initial stage, will be collected together for:

Draws:
the relevant Draw and the prizes will be allocated to valid entries in the order drawn, with each Draw being carried out at random under the supervision of McDonald's or via a computer programme producing a verifiably random draw.

Competitions:
the relevant competition and will be judged in accordance with any age or other criteria stated in the Promoter's Rules or (if none) as to which entry complies with the Entry Criteria in the most apt and original way and (in the case of a player escort place prize only) demonstrates best effort, focus and commitment by the entrant or the child nominated by the entrant towards football in the context of that child's personal circumstances.

The details of judges shall be available by submitting a written request with a stamped self-addressed envelope marked with the name of the Competition and the word "Judges".

Neither the Promoter nor McDonald's shall be obliged to contact any unsuccessful entrant.
General Provisions Applying to every Promotion (to the extent not in conflict with the Promoter's Rules)

As well as details of names and counties, each entrant agrees that McDonald's may publicise statements made by or attributed to any entrant relating to McDonald's in connection with a prize, together with the entrant's likeness and background, unless otherwise requested (and on the understanding that such a request may not be made if the Rules stipulate that the provision of a publicity-consent form is a condition of entry).
McDonald's may require such information (in addition to the information required to be given on prize claims) as it considers necessary or desirable for the purposes of verifying any claim and a claimant's compliance with the Rules and any prize may be withheld unless and until McDonald's is satisfied with the verification. Should McDonalds determine based on the evidence in its possession at any given time that an entrant is in breach of the Rules, then it may adjudge (in its discretion) that such entrant is ineligible to take part in any Promotion and every other promotion or offer of McDonald's and every prize due to be provided by McDonald's, entry and/or claim by that entrant then in process and still to be made shall be deemed invalid and void from the outset.
A list of the names and counties of prize winners may be posted by McDonald's on its Site, but if not, details can be obtained by contacting the Customer Services number notified on www.mcdonalds.co.uk and obtaining the contact name and address to which to send an envelope with a signed hand-written specific request and a stamped addressed envelope.
Entry to a Promotion amounts to acceptance of the Rules and to their interpretation under English law and by the English courts. All age limits shall be deemed to be actual age as at the time of acceptance of the Rules, unless expressly stated otherwise in these Rules.
Nothing in the Rules shall affect any entrant's statutory rights. McDonald's may (in its sole discretion) decline to enter into any correspondence save as otherwise stated in these General Rules.
PRIZE DESCRIPTIONS & CONDITIONS

For any Promotion featuring one of the types of prize listed below, the provisions set opposite shall apply:

Match Tickets for the FA Community Shield Match and England, Scotland, Wales and Northern Ireland Senior Men's Team International Home Games

Each prize will comprise either a pair of tickets or a set of four family tickets, as stipulated in the Rules.
Each set of family tickets allows entry for four people, although there can be a maximum of only two adults over the age of 18.
All prize winners and their companions shall comply with the ticket conditions of the relevant national football association/stadium responsible for hosting the relevant match; any person in violation will be refused entry to or expelled from the stadium with no right of compensation. Further details available upon request.
Prize winners and their companions (if applicable) are required to carry proof of identity (with valid photograph and signature) when entering a stadium and are required to comply with all applicable safety and security regulations of the stadium.
If any winner is under 18 (and still eligible under the Rules), the winner's parent or legal guardian must claim the tickets in place of the winner and the tickets will be issued in the name of the winner and that parent or legal guardian.
The details of each winner and winner's companion(s) may be submitted to the National Criminal Intelligence Service to be searched and anyone with a Football Banning Order (or other conviction considered by McDonald's to be inappropriate for the award of Tickets) may be deemed ineligible for the Promotion at McDonald's discretion (and without requirement for McDonalds or the Promoter to serve notice) and all prizes (whether or not already awarded) and prize-claims of the winner may be declared invalid and deemed void from the outset for that winner and the winner's companion(s).
Player Escort Programme places

Each prize comprises a place on McDonald's Player Escort Programme comprising the right to accompany a player in the team for player (both of which are solely determined by McDonald's) at the match identified for that Promotion (and the date and venue for each match are as described in the Rules but are subject to change.
The award of each prize is conditional upon:

compliance with the terms and conditions for tickets and stadia as stated in the section for Match Ticket prizes above, the parent or guardian of each prospective player escort accompanying that child, and the receipt by McDonald's of the properly completed, designated, liability release form(s) (prepared by McDonald's and releasing, wherever permitted by law, McDonald's and the relevant football association, their related companies, franchisees and agencies concerned with conducting this Promotion and their respective employees, officers and agents from responsibility or liability for claims from the player escort or the parent/guardian in respect of the prize) and certification form (which will include undertakings that the person is the parent/guardian of the player escort, that they have complied with the Rules and they will accompany the player escort) by the time stipulated in the Rules or (if none) by no later than 14 days after the date upon which notification of the award is first sent on behalf of the Promoter/McDonald's (failing which the prize claim will be void and the prize may be made available by McDonald's to the Promoter for re-award (provided that this shall be at the sole discretion of McDoanld's).
Prize includes official Player Escort Programme clothing comprising shorts and shirt but children MUST bring their own trainers to wear on the pitch and which must not be studded.
The certifying/accompanying parent or guardian of each escort can claim a contribution towards travel to/from the relevant match, which will be paid by cheque addressed to the parent/guardian and posted to the address registered upon entering within 21 days after the match. The amount of such contribution shall be determined by McDonald's assessment (in its sole discretion) of the approximate road-distance between the said residential address and the match venue and the highest applicable rate (only) of the following: Under 50 miles - £15, under 100 miles - £25, under 150 miles - £50, under 250 miles - £75 and 250 miles or over - £100. The actual mode/cost of transport taken by the player escort, parent/guardian and (if applicable) other companion(s) won't affect the amount of the contribution.
Additional tickets cannot be purchased in the same area as the one designated for the player escorts and their parent/guardian to sit to watch the match and may only be purchased via the general public sale (subject to availability). Each player escort and all companions (including the accompanying parent/guardian) must follow the instructions of the staff of McDonald's, the relevant football association/stadium when claiming the prize and whilst at the venue.
Player escorts shall not be permitted to select the team whose kit they will wear and shall not be permitted to select the player who they will escort onto the pitch for the match.
Player escorts and accompanying parents/guardians agree to enter into any waivers/clearances requested by McDonald's in relation to usage by McDonald's in its marketing (including on the Site and the relevant football association website) of any footage and photographs taken of the player escort and all companions (including the accompanying parent/guardian).


Player Escorts for the FA Community Shield Match and England Senior Men's Team International Home Games Designated as Player Escort Matches:

A player escort must be aged between 7 and 11 years old (inclusive) at the time of the relevant match, except for UEFA matches where the age must be between 6 and 10 years old (inclusive).
Each player escort prize comprises up to 4 tickets for the match, two of which must be used by the escort and accompanying parent/guardian.
McDonald's may (in its sole discretion) also select a player escort to present the Man of the Match award at the end of the Match.


Player Escorts for the Scottish Senior Men's Team International Home Games Designated as Player Escort Matches:

A player escort must be aged between 7 and 11 years old (inclusive) at the time of the relevant match (until further notice).
Each player escort prize comprises up to 3 tickets for the match, two of which must be used by the escort and accompanying parent/guardian.


Player Escorts for the Welsh Senior Men's Team International Home Games Designated as Player Escort Matches:

A player escort must be aged between 7 and 11 years old (inclusive) at the time of the relevant match.
McDonald's will provide 2 tickets for the purposes of the player escort and accompanying parent/guardian.


Player Escorts for the Northern Ireland Senior Men's Team International Home Games Designated as Player Escort Matches:

A player escort must be aged between 7 and 11 years old (inclusive) at the time of the relevant match.
McDonald's will provide 2 tickets for the purposes of the player escort and accompanying parent/guardian.
Extension of the Player Escort Programme: McDonald's may extend the Player Escort Programme to selected matches for the Men's Under 21s and Senior Women's National teams for one or more of the above nations in which event prize-places for such matches shall also be covered by these Rules.
General Conditions For All Prizes

Limit of one prize per winner per year per Promotion-type, unless otherwise stated in the Promoter's Rules.
Contact McDonald's via the Customer Services facility as notified on the Site to receive the contact name and address to which to send a stamped SAE in a stamped envelope marked as directed and which must be received during the 30 days' period after the closing date for receipt of entries for the relevant Promotion, in order to receive (1) further details of a prize supplied by McDonald's and any prize-conditions or (2) details of the judges of any Competition in respect of which McDonald's is organising the judging.
For Competitions for which McDonald's arranges the judging, the judges' decision will be final and McDonald's may (in its sole discretion) decline to enter into any correspondence save as otherwise stated in the Promotion Rules
All prizes are subject to change in specification and McDonald's reserves the right to change from those advertised in the event that supervening circumstances make this necessary.
In the event that McDonald's wishes to increase the prize pool for any of the Promotions, it may (but shall not be obliged to) do so.
Prizes which are for physical delivery, shall be dispatched by special delivery post (or other means selected by McDonald's).
Unless otherwise set out in the Promoter's Rules, winners are solely responsible for organising at their own cost all necessary travel, accommodation, subsistence, insurance, travel permits/documentation and other necessary or desirable features to enable the taking of the prize.
Prizes may not be exchanged for any cash or other alternative, are not transferable, divisible, permitted to be sold or resold and are not for use in conjunction with any other promotion or offer. Prizes cannot be replaced or refunded in the event of loss, theft or missed opportunity.
All prizes which are un-awarded, unclaimed or subject to claims which become invalid or which are adjudged void at any time, will lapse and may be re-awarded by McDonald's (but without obligation to do so).
Provisions applying to all Prize Claims

Each prize winner (or, if relevant, the winner's certifying parent/legal guardian) will be notified in writing by post to the address stated at the time of entry within the time stated in the Promoter's Rules or, if none, within 30 days of the closing date for receipt of entries.
Prizes which are capable of being sent by post and which do not require the winner (and/or the winner's parent/guardian) first to send signed liability release, certification and/or publicity-consent forms as a precondition to the award, will be sent by McDonald's at the time of sending such notification.
Where prize conditions require the winner and/or parent/guardian to first send signed liability release, certification and/or publicity-consent forms as a precondition to the award, McDonald's shall send to the winner (and parent/guardian if appropriate) with the notification in 30 days of the closing date:

(if applicable to the trip) notification from McDonald's by letter of the prize claim including whether McDonald's needs to make further contact to obtain further details (in which event it is the responsibility of the winner's certifying parent/legal guardian to make him or herself available for such further contact and to ensure that such outstanding details are finalised within any further time limits as McDonald's stipulates), and the relevant (i) liability release form (prepared by McDonald's releasing, wherever permitted by law, McDonald's, its related companies, franchisees and agencies concerned with conducting this Promotion and their respective employees, officers and agents from responsibility or liability for claims in respect of the prize) for the winner and certifying parent/guardian (together with each other companion permitted to take the trip as part of the prize package, if any) (ii) certification form and/or (iii) publicity-consent form all of which must be properly completed and returned to McDonald's at the address and within the time as directed at the time of notification, failing which the prize will be withheld and that winner's entry and prize claim will become void.

RESPONSIBILITY

To the fullest extent permitted by applicable law (but not otherwise) McDonald's and its agents and/or commercial partners assume no responsibility and are not liable for:- (i) the accuracy or otherwise of any prize description or illustration, (ii) (where applicable) the non-availability, loss, late receipt or damage of any text, prize-claim, prize or notification or other communication and whether by reason of mobile-telephone network-operator error or other problem, failed or corrupted transmission, handset failure (including full or unserviceable inbox) or otherwise, (iii) (other than those warranties or conditions implied by statute and which cannot be excluded) any representation, warranty, condition or guarantee in respect of a prize (iv) (where applicable) any person whose mobile phone is used to text-in an entry without the owner's permission, or (v) any taxes, fees, charges or other costs which winners may be required to pay at any time in connection with a prize, (save to the extent that the Promoter or McDonald's has expressly and specifically accepted responsibility in the Rules for the same).

All prizes sourced by McDonald's from other suppliers remain the property of those suppliers pending delivery to winners.

MCDONALD'S RIGHTS

McDonald's may (i) extend any time limit or waive any of the General Rules where a person might otherwise have been disqualified (without obliging McDonald's to relax the General Rules on any further occasion for that entrant or at all for any other person), (ii) terminate, extend or suspend the Promotion at any time where this is necessary or desirable due to supervening circumstances beyond McDonald's control, and (iii) substitute a product deemed to be an appropriate replacement and of equal or greater value in the place of any of the prizes (or any part of a prize to the extent divisible). McDonald's decision in the exercise or interpretation of any of its rights or discretions in connection with these General Rules shall be final and binding.

PRIVACY POLICY

In administering this Promotion, the Promoter and McDonald's may collect personal information from any entrant and, unless it has first obtained the entrant's consent, the Promoter and/or McDonald's (i) will not collect more of the entrant's personal information than needed for the purpose of administering and analysing this Promotion (including carrying out security checks as stated) and for posting features on its Site which are informed by one or more entry-submissions, (ii) will only use the entrant's personal information for those purposes (and such use may include transferring the entrant's personal information to McDonald's respective associates and to any applicable sporting body for the purposes of security and monitoring, and (iii) will not transfer the entrant's personal information outside the European Economic Area unless it is permitted to do so under the Data Protection Act 1998. As it is impracticable for the Promoter and/ or McDonald's to verify with any certainty the age of those who enter a promotion or subscribe to an offer via SMS, web-form, email or telephone, the Promoter urges parents to regularly monitor and supervise their children's mobile phone/computer/telephone activities.

may be made by contacting the Customer Services number notified on www.mcdonalds.co.uk and obtaining the contact name and address to which to send an envelope marked "Data Protection Request".

The Promoter:
may be made by writing to the address set out in the Promoter's Terms.

Selected prize providers (depending upon the nature of the prize and whether in addition to or in place of the entrant providing personal data to the Promoter and/or McDonald's) may require any entrant to provide to the prize provider personal data in connection with claiming a prize and the entrant should review the privacy policy of that prize provider, as neither the Promoter nor McDonald's can accept any responsibility for this.
